HB11-1107: State Illegal Immigration Enforcement Bill This Colorado House version of the Arizona SB1070 law was pulled by its chief sponsor, Rep Baumgartner (R – Hot Sulphur Springs), who cited concerns with the bill’s constitutionality. A large coalition of business interests and advocacy groups along with the Denver Post opposed the legislation.

SB11-054: Authority to Arrest Unlawful Aliens This Colorado Senate version of the SB1070 law was defeated in the Senate State Affairs Committee thanks to the principled votes of Sen. Rollie Heath, Sen. Betty Boyd, and Sen. Bob Bacon. The hearing testimony was 12-2 against the bill. Thank you to all who came out to testify on the effects this terrible legislation! SB11-129: Mandatory E-Verify for All Colorado Employers This costly bill to require E-Verify use by all private employers in Colorado failed on a 3 -2 vote of the Senate State Affairs Committee with Senators Boyd, Heath, and Bacon once again voting to kill the measure. Testimony was just as one sided, 11 to 1 against the bill.

HB11-1088: Bond for Persons Illegally Present HB 1088 would require law enforcement agencies to "determine" if a defendant, upon charging or arrest for a felony or class 1 or 2 misdemeanor, is undocumented, and then would require that the District Attorney and Pretrial Services be notified. This is another insidious way to bring Arizona-style legislation to Colorado, infect the criminal justice system with erroneous immigration status considerations, and disproportionately impact the Latino community, as well as vulnerable and indigent populations. HB 1088 may also have a fiscal impact on local communities, raise serious constitutional concerns, and encourage anti-immigrant sentiment.

HB11-1140: Strengthening Illegal Alien Laws This proposal would punish localities that choose to opt-out of the Secure Communities program by denying them State funding. The bill made it out of the House and is heading for the Senate.

HB11-1049: Use of Personal Info To Defraud This proposal would inappropriately expand the Identity Theft statutes, which involve conduct that does not encompass the concept of theft. This bill would adversely impact the state budget; violate basic principles of proportionality in punishment; and disproportionately impact immigrant and low-income communities. (At this point the bill will likely die in its current form, and be brought back in a much more focused and less-harsh version)
